[194 Wash Page 78] BLAKE, J. -- At the general election held in November, 1934, plaintiff was a candidate for the office of county commissioner of Whatcom county, first district. Of the votes cast for that office, he received more than any other candidate. He was declared duly elected for a term of four years, and received a certificate of such election. The following January, he entered upon the duties of the office, after taking the oath and filing a bond as required by law. He has since continued to perform the duties of the office, and until January [194 Wash Page 79] of this year, has received the salary incident to the office.
